Sodomy II: Why Najib and Rosmah won't testify and who is stopping them

It should not be any surprise to Malaysians when Opposition Leader Anwar Ibrahim’s third attempt to dismiss the judge was turned down. The judiciary has firmly been working against Anwar since Sodomy 1 in 1998 and now in Sodomy 2.

The charge made against Anwar Ibrahim is under Section 377B of the Malaysian Penal Code. A rather odd and mind-boggling section to begin with.

Section 377 defines oral sex and any forms of sexual activity other than what is deemed natural both illegal and punishable by law.

Section 377B reads, “377B. Committing carnal intercourse against the order of nature - Whoever voluntarily commits carnal intercourse against the order of nature shall be punished with imprisonment for a term which may extend to twenty years, and shall also be liable to whipping.”

Note the word “voluntarily” - for the charge to be proven exactly, it must be proven that the accuser Mohd Saiful Bukhari Azlan voluntarily allowed the act to be commit, which makes him also liable for charge under the same statute.

Acquitted but not innocent.

Razak Baginda has been acquitted by the courts for abetting in the murder of the Mongolian, Altantuya. Acquitted because the persecution failed to put together a case to show his involvement. Fault lies with the persecuting team. But acquittal does not mean innocence. One may be guilty as hell but if the persecution fail to put a case together against you then there will not be any case at all. The courts cannot hold you accountable to any crime if it cannot be proven. And this is the case with Razak Baginda.


Yes, he admitted to having an affair with Altantuya and this is (thus far) his involvement with the Mongolian but did he kill her? That's the bigger question. Is he innocent? It is open to debate. Acquittal merely means there is no court case against you.


So now the case will shift to the two accused, who must now enter their defense for the murder of the Mongolian.


A certain Incoming Prime Minister is sighing a relief. The one connection he had with this murder is now set free. It would fair to say that this case is closed and would only be looked upon as another murder case. Suffice to say, Malaysian's will move on to other matters and whatever shadowy dealings that conspired to bring about the demise of the Mongolian will never be brought into the light of day.


This is the real tragedy of this case. The suppression of truth. We will never know how C4 was obtained. We will never now how immigration records can be deleted. We will never know who gave the order to terminate the Mongolian's life.


Too many questions are left unanswered. The so called police investigation only points to the fact that two police officers stepped out of their way to shoot and blow up a helpless Mongolian woman.


The truth is definitely still out there.

Irresponsible (incoming) Prime Minister

Will this get me into trouble? I think it will because going by track record, most people who written critically about him have been put into prison. ISA and all have been used and well I may even be strapped to C4 and made into fireworks.


The person I'm talking about is our Incoming Prime Minister (IPM). When asked about the accusations concerning the Altantuya case especially in light of the SMS messages that appeared on Malaysia Today, he merely replied by pointing out that Abdullah Badawi has commented on it.


"Was there any abuse of power?" The reporter asked.


"Oi, my boss already say, he thinks I am not the kind of guy to abuse my power," was the reply.


Having Abdullah Badawi answering for you is kind of cute in a way because then you are cleared of every charge without having to acknowledge or deny anything. How convenient, we all should do that or at least work for bosses like Abdullah Badawi. In truth this reply by IPM is really irresponsible. It clearly shows a leader who would wash his hands clean of any fault and point it at another guy. Childish behavior like this have no place in the highest office of Malaysia.


Abdullah Badawi believes he is incapable of abusing his power. This is what Abdullah Badawi believes in but it may not be the truth of the matter. If what we read in the SMS are true and if they show a non-abuse-of-power, then surely the state of our governance in Malaysia is so, so poor. Minister's can and will be involve in court cases or police investigations if it is detrimental towards them. Abdullah Badawi's statement and IPM affirmation of that same statement suggests that the actions of IPM in the SMSes should be expected of all our high-ranking ministers.


Why can't IPM answer for himself? Deny the allegations and tell the truth. Stop trying to hide behind other people or abuse the laws (ISA) and make your problems disappear (literally).


I see trouble times ahead with IPM in power. There will be increased persecution of people who bring out the truth in governance. Bloggers may end up cell mates with RPK and anyone speaking up against the establishment may find themselves turned into impromptu Roman Candles of the exploding kind.

Would a change in leader fix anything?

I'm being pessimistic. I don't really think a change in leadership would bring any good for Malaysia, if the leader comes from the same political affiliation as the past leader. Reason being? Same baggage.


Najib Razak will carry into his term the same old stuff Abdullah had to deal with and probably have the same support team also. Would this change anything? The same old gang is running the palace and the same practices will still be in place. Nothing has change. Everything is just as it was before. So whether Pak Lah leaves today or in March makes no difference. The same state of affairs will still be dominate over Malaysia. Our economy will be heading south, the people would still be facing bleak times and there will still be political chaos. It doesn't really address the root problem - poor governance at large.


The MPs should be allowed to lead by conscience and by party lines. The MPs should highlight the problems of the citizens living in their areas. Government policies should strive to better the lives of the people of Malaysia rather than enrich a certain group of people or party members. What is really needed is a change in governance style.


Can Najib bring about this? I really do not know. With the Altantuya case coming to conclusion, the results will no doubt haunt Najib not to mention the stigma that case has brought onto the Prime Minister in waiting. It will be Najib that has to face a bleak 13th General Election where the BN may finally be tumbled from its pedestal. At the rate the current government is going, BN may just be opposition after the 13th General Election.


Can Najib handle Anwar Ibrahim? Another case to watch for in the coming months after March 2009. It would be interesting if Anwar Ibrahim can install his government before March 2009 then all this wondering if Najib is capable can be put to rest and at least we know, RPK would be set free from ISA. I do not think Najib can handle Anwar Ibrahim. Left to his own devices Najib may be as weak as Pak Lah.


What we need is a leader who has fire in his belly. Someone who would grab Malaysia by it's collar and say, let's move on. Someone who can tell off the parliament. It should be a leader who inspires the populace to step forward and be counted. This is the leader we need and currently, I don't see that in UMNO.

A Malaysia lost in scandals.

Another explosive day when just 24 hours after making a Statutory Declaration, Balasubramaniam retracts it and makes another one where there is no mention of Najib. So what gives?

This would go down as the weirdest 24 hours in Malaysian history. First Najib is implicated as being the person behind the Altantuya murder and then in a surprise move, his accuser makes an about turn and says he wasn't. I believe Razak Baginda must be screaming his lungs out now. Wondering what ever came over Balasubramaniam.

It's a twisted tale and a mockery of the courts. A Statutory Declaration is a legal document. Can one simply retract it on a flimsy reason, "I was force to make it"? It is a binding document and a serious document where one makes a declaration under oath that whatever he states is the truth (according to him) of the matter. By retracting it in this manner, Balasubramaniam has made a mockery of the courts. Or was he made to retract the SD? There is always the possibility.

This sets the stage for more name calling and finger pointing. The government will be quick to point the finger at Anwar Ibrahim as being the one orchestrating the downfall of Malaysia. Yes, Anwar is being painted as a traitor to the country and worthy of stoning. Yet, if Anwar is a traitor by virtue that he seemingly reports back to Washington all that happens here then truly the other ministers are no less traitors.

Corrupted officials, who pocket the rakyat's money are traitors of the highest order. They have done wrong not only to the country but also to the people of the country. They are traitors to 26 million Malaysians who entrusted them with their welfare and livelihood. After 100 days, the BN government has little to show for except going on a witch hunt to get Anwar and merely to make decisions only to retract them later (twice salary payment for civil servants). This is a scandal in itself. How could a decision be made by the highest official figure in the country only to be retracted and reversed?

It seems everything in Malaysia can be reverse once it's made public. I wish they reverse the decision to raise the price of fuel...but wait. The price was raised and then decided on...silly me. That was a case of "shoot and ask questions later."

There is turmoil in the government. Scandals upon scandals are being played out before us. Who then is fit to lead Malaysia? If there is a hint of scandal for Najib then what about the other ministers below him? Is the whole cabinet not without scandals or are we just waiting for another SD to be release that implicates another minister and open another can of worms?

Is Najib fit to lead Malaysia?

The plot thickens right on the heels of Rosmah's denial that she is involve in the Altantuya murder case as stated by Raja Petra Kamarudin in his statutory declaration where he named Najib's wife Rosmah Mansor as being directly involved in the Mongolian's death.Najib denied his wife's involvement and Rosmah followed suit. Najib has always denied any involvement in the Altantuya murder case and made it clear that he did not know Altantuya even when his name was mentioned by the murdered Mongolian's cousin during questioning in court.

Najib was never investigated but always held suspect.

In a previous post I questioned whether Najib is innocent. The trial has raised too many questions and most point back to Najib. Apart from the occasional denials and assurance from Pak Lah, we are fed, by main stream media, with the idea that Najib is clean. But mere denials only leave the door open for inference and speculation on his role in the Altantuya murder. Until and unless Najib is truly investigated and cleared can we say, without any shadow of a doubt, that he is innocent. When he was given the chance to submit himself to investigation, it was engineered that he wouldn't. Now it seems, Najib will finally be investigated.

Najib is now feeling the heat with the explosive statutory declaration by Balasubramaniam the former private investigator employed by Razak Baginda to look out for Altantuya when she was in Kuala Lumpur.

Among the claims of Balasubramaniam as reported on Malaysiakini:

Selain maklumat tersebut, dakwa Balasubramaniam lagi, penganalisis politik yang dekat dengan pemimpin negara itu juga memberitahunya:
* Najib memaklumkan kepada majikannya itu bahawa mereka berdua pernah melakukan hubungan seks.

* Oleh sebab beliau sekarang timbalan perdana menteri, Najib meminta Abdul Razak menjaga Altantuya agar wanita berkenaan tidak mengacaunya.

* Ketiga-tiga mereka – Najib, Abdul Razak dan Altantuya - didakwa pernah makan malam bersama di Paris.

* Altantuya menuntut wang komisyen sebanyak US$500,000 daripadanya berhubung pembelian kapal selam Malaysia di negara itu.

According to the statutory declaration by Balasubramaniam, Najib not only knew the Mongolian, he knew her on an intimate level. If true, then this supports RPK's declaration that Rosmah was involve personally in the Mongolian's demise.


There is clear motive for Rosmah to be involve personally with Altantuya especially with the revelation that Altantuya was formerly Najib's lover and that Razak Baginda was instructed by Najib to "support" her financially. Najib's involvement is heavy in the Altantuya murder, for it seems clear now that he could be the one given the instructions in the background.

We could speculate that it gives enough reason for Rosmah to obtain C4 and blow up the poor Mongolian. And we all wondered why C4 was used or why blow up a dead woman? Crimes of passion sometimes defy simple logic because they are motivated by emotions and this case jealousy and anger are strong enough emotions.

Would the police investigate the allegation in Balasubramaniam's statutory declaration? Would we see an investigation that is not tainted by hidden instructions from those in the halls of power?

Would the heir apparent, Pak Lah's successor to the premiership be investigated?

Pak Lah has given his statement that he believes Najib is not involve in the Altantuya case.

This new revelation that Najib (true or not) is involve would only mean Pak Lah is either lying or ignorant to what happens around him. Again it shows how messed up the government of Malaysia is and regardless of the outcome, we would start questioning - "Is Najib fit to lead Malaysia?"

Is Najib really innocent?

You are guilty until proven innocent. I thought that only applied in Italy where the courts determine your innocence rather than your guilt. Its a skewed way of doing things and in most cases its harder to prove your innocence than your guilt. So there is a chance even an innocent is sent to jail for their in-ability to prove that they are not-guilty.

So here is the case. Is Najib really innocent? Or are there elements of guilt in his dealings with the Altantuya case? His innocence would have been assured if at the moment his name was mentioned during the early days of the trial, he was investigated. Knowing the way Malaysian courts work (especially towards those who walk the corridor of power) he would have been acquitted and proven innocent. This would have settled it once and for all. But that did not happen. Instead, the judge made a funny statement that only three people were involved in the murder and no-one else. A statement which effectively closed all avenues to investigate possible links to other individuals. Thus, it set the stage for denials upon denials and denials are empty unless supported by proof.

At the moment it is a case of RPK's word against the collective word of Pak Lah, Najib, Rosmah and Khairy.

Malaysiakinireports that Najib denies his wife was ever involved as stated by RPK.

Pak Lah has denied receiving any report as stated by RPK and went one up by saying Najib is innocent. Can we really trust Pak Lah on his word when all this while we've been hearing mere rhetoric from him?


Khairy has been brought into the picture and again, I believe he would deny any involvement. So there is a lot of denial going around among this circle of 'friends'. Who then is telling the truth?

Malaysia being Malaysia, we tend to go with the majority. The more people denying would mean it is the truth, even if the truth is a lie. In this case, Najib would be painted as a trust-worthy man who is speaking the truth but he made a blunder.

"Mencemarkan imej politik beliau" that was the statement he made. Does RPK have a political agenda? I don't think so. RPK is bringing back to light (in a genius way) what should have been done in the first place; the day Najib's name was mentioned during the trial - he should have been investigated. This has happened, in a rather round-about way. There is no political agenda here. It's a human agenda, an innocent person was killed and all those involve need to prove their innocence. Why didn't Najib allow himself to be investigated and proven innocent at the onset of the Altantuya trial? Did he have anything to hide?

Najib at this juncture would be stained for life. Even if he is proven innocent, the stigma of being entangled in a murder would stick. Plus, it's not just him - his wife is entangled too. Whether RPK proves himself right or not, the damage would have been done.

Folks, RPK will take the fall - which ever way the courts would decide it. If RPK proves his case, Najib would fall and Pak Lah and gang would be seen as a bunch of liars. If RPK is proven wrong and sent to jail, Najib would be cleared but he would be tainted and can we really trust this man to be the next PM? Politically Najib will survive (politics is weird in Malaysia) but much is desired from him as a person.

If Najib was really innocent, he should have allowed himself to be investigated from the beginning of the Altantuya case. Get my drift? An innocent man would strive to prove his innocence anyway possible because in Malaysia, you're guilty until proven innocent.

Raja Petra Kamaruddin makes his stand, the Spartans would be proud!

King Leonidus would be proud. He stood with 300 men against a horde of invading Persians and a legend was born. He single-handedly help shaped the course of civilization as we know it today. I am proud to say, Raja Petra Kamaruddin (RPK) is making that stand and he's going to shape Malaysian history.

Malaysiakini is abuzz (the MSM is silent on this) with RPK's statutory declaration that Najib's wife was at the crime scene where Altantuya was murdered. Malaysiakini reports:

"It's mindboggling!" - that's how Raja Petra Kamarudin's statutory declaration alleging that Deputy Prime Minister Najib Razak's wife was at the murder scene of Mongolian national Altantuya Shaariibuu was described today.

This would put a wet blanket on Najib's aspiration to be the next prime minister. Would you like having a PM whose wife likes to blow-up stuff? I mean maybe she was a quarry worker in a past life but that's one wicked woman there.


So let's not forget, this government is already having a massive headache in managing itself ever-since the General Election, now they have to contend with runaway MPs plus you have a deputy prime minister with an elephant skeleton in his closet. The plot just keeps on thickening and its better than anything Stephen King could write. Yes, the drama in Malaysia is "mind-boggling" better than anything we could watch on tele.

In other countries, government officials would resign with a hint of speculation of scandal but in Malaysia our government seems to thrive with scandal. So people like RPK are heroes, for they expose our government officials for who they really are. Robbers and liars.

So Najib, what would you do now or is your wife going to blow up RPK with C4?
